Terms and Conditions
The following is an agreement between the Producer and Bughouse Theater, 501(c)3. By initialing, paying the associated invoice, verbally agreeing to, or Producing a show at Bughouse the producer agrees to the following terms and conditions, and affirm that they will abide by the expectations and policies outlined below.
For the dates and times specified by invoice or other correspondence…
01. Bughouse will provide...
Unless otherwise specified Bughouse Theater will provide:
-8 channel PA system (with 3.5mm male aux headphone plug)
-Projector and Screen with HDMI video capability (Audio must be run through PA)
-One microphone
-Light board with full wash capability and one center focused fresnel special light.
-WIFI (password upon request)
-For performances, a house manager from the theater to assist you with basic needs. They will be able to let you in the theater 45 min prior to your show, unless other arrangements are made.
-Shelby, Artist Director, or Joe, Executive Director, may be available to also provide assistance by phone the day of the show.
-Once submitted promotional materials are approved, we will most likely post them on our social media accounts. Timing of this may vary and is at the discretion of our marketing personnel.
02. WHAT BUGHOUSE IS UNABLE TO PROVIDE…
At this time we are unable to provide:
-a stage manager
-Tech person for running your show
*Bughouse Staff will most likely be acting as House manager and box office staff and may not be able to help. They should not be expected to fill any of these roles. If needed, we can provide a handful of names for tech personnel that you may hire separately.
03. WHAT THE PRODUCER IS EXPECTED TO PROVIDE…
The Producer agrees to provide:
-The names and contact information of all Co-Producers involved.
-Promotional materials should be sent to socialmedia@bughousetheater.com for approval.
-At this time, promotional materials should list a ticket price or, if a donation based entry (Buyouts and Donation shows only), list the show as "Pay what you can." or suggest a donation amount. Please refrain from listing the admission as "free".
-Email confirming which plan you have chosen
-Provide your own tech staff if needed.
04. BYOB POLICY
The following BYOB policy is a material clause of this contract and which we take very seriously.
We are A BYOB establishment, with certain limitations. No one affiliated with Bughouse, nor a producer of any show, nor a performer of any show may give alcohol to an audience member. The BYOB designation is intended for individuals to bring their own beverages to consume. A group of legal aged performers may share alcohol among themselves, a group of legal aged audience members may share alcohol among themselves, BUT AT NO POINT should anyone who could reasonably be confused as acting on the theater’s behalf (producers, performers, staff, etc.) give, distribute, or reveal the location of any alcohol. That means handing out cans OR pointing to a cooler where cans are kept. We cannot provide cups. We cannot provide bottle openers or corkscrews.
05. INSURANCE
For insurance** purposes, your production will be considered a co-production of Bughouse Theater for the duration of the run from first rehearsal or performance, whichever is earliest, to final performance or rehearsal, whichever is last. Bughouse DOES NOT claim any rights over intellectual property generated in the process, nor accept any liability or responsibility for material presented on stage. Likewise, Bughouse does not accept any financial responsibility for the production.
The co-production arrangement is strictly for the purposes of qualifying the producer’s activities in the Bughouse space as insurable. In the event of suspected illegal activity or breach of contract, Bughouse does reserve the right to review and edit all video, sound and photographic recordings from the event(s) in question.
**If your production company carries its own insurance please provide a Certificate of Insurance with our address listed (Bughouse Theater, 1910 W. Irving Park Rd, Chicago, IL 60613). In this instance your production will NOT be considered a co-production of Bughouse Theater and all of your activities will be covered under your insurance policy.
06. RENTAL PLANS
Rentals rate plans are as follows: Please consult your invoice to confirm for which plan you are signed up, the time and date of you shows and pay the appropriate amount prior to the deadline. This is considered a material clause of the contract and failure to pay the deposit by the communicated deadline may result in voiding the agreement.
All show slots, unless otherwise specified, are 2hr hours long, consisting of 30 min prior to show’s start time and 90 min after the start time. If the allotted time is exceeded by the Producer, Bughouse reserves the right to charge an overage fee based on the original deposit amount.
The deposit structure is as follows:
Sun-Wed and matinees (shows ending prior to 5pm): $100
Thu-Sat: $150
70 / 30 Plan: Producer pays fee in full up front. Producer recoups rental amount from the top of the ticket sales. Producer and Bughouse split proceeds 70/30 after Producer has broken even.
50 / 50 Plan: Producer pays half the fee up front. Bughouse takes the other half of the fee from the top of ticket sales. Producer recoups their half next. Producer and Bughouse split proceeds 50 / 50 once both parties have broken even.
For rentals, we ask that tickets be set at a $10 minimum.
BUYOUT Plan Rates:
Sun-Wed: $200
Thu-Sat: $300
Producers keep 100% of ticket proceeds after credit card processing fees and other 3rd party service fees*
The producer may set the ticket price and if so desired, and may choose to use their own ticket seller instead of the one used by Bughouse. This choice will necessarily exclude their show from Bughouse’s calendar and website as it is populated through our ticket seller service.
DONATION Plan
No deposit required. Producer agrees to give 100% of the proceeds to Bughouse Theater.
*Bughouse does not itself charge any processing or service fees, but our Point of Sale company and Ticket seller do.
07. CONFIRMATION and CANCELLATIONS
Shows slots are considered confirmed once the deposit has been paid and the terms and conditions signed. Unconfirmed shows may appear on the Bughouse Theater website and schedule, this should not be an indication that the show is confirmed. A producer may receive clarification of the title, dates, times, price and other finalized details of the proposed show. Clarifying the details of the proposed show does not guarantee or confirm that the show will be taking place. Only payment of the deposit and signing of the contract can ensure that the show will be taking place as discussed.
In the event that Bughouse must cancel a confirmed show, the deposit will be refunded, otherwise deposits are non-refundable.
In the event that a show requires no deposit, or the Producer has been given a credit towards the deposit and no money need trade hands, written acknowledgment of this fact from Bughouse shall suffice as a confirmation that the show is indeed scheduled to proceed.
Upon cancellation by producers, renters or any other party contracted to use the theater space, Bughouse will be under no obligation to refund the deposit, carry-over the positive balance or otherwise honor the agreement.
08. REHEARSALS
For Rehearsals, you may be asked to let yourself into the theater and lock up when you leave. In those instances, other instructions will follow or you may request instructions.
If you need a tech rehearsal prior to your event, please request a link to reserve a time. Tech rehearsals are offered at a discounted rate of $10/hr
09. NON-DISCLOSURE
Bughouse Theater and the Producer agree not to disclose the contents of emails, texts or communication between themselves regarding the show(s) produced or to be produced to any third party or individual not listed. Failure to keep communications private may result in legal action to recoup damages from loss to reputation, legal fees, and fines and penalties resulting from the disclosure.
10. ACKNOWLEDGMENT
I, the producer, take full responsibility for any fines, penalties or legal consequences incurred after the disregard of any part of this agreement, specifically, but not limited to the BYOB and alcohol policy. I recognize that disregarding any material clause voids the contract and Bughouse Theater is under no further obligation to me. Though they may choose to honor certain other portions of the agreement, I will hold them blameless, if they do not.
11. FUTURE PRODUCTIONS
This agreement will carry forward and apply anytime the Produce books a performance or event at Bughouse. They will only need to sign it the first time. If the agreement changes they will be asked to sign the revised version the next time that they book an event.
